DOMESTIC VIOLENCE AGAINST WOMEN AND THEIR MENTAL HEALTH

ABSTRACT:


Domestic violence against Roman is a major Public Health issue in today's world. It refers to the violence from the household and within relationships that covers the family. The purpose behind writing this article is to protect women against domestic violence and to guide them about few laws made against domestic violence.


INTRODUCTION:

Domestic violence is also named domestic abuse and family violence. Domestic violence can take place in heterosexual or same-sex relationships. Domestic violence also involves violence against children, teenagers, parents, or elders. A purple Ribbon is used to promote awareness of domestic violence. In some countries, domestic violence may be seen as justified or legally permitted, particularly in case of actual or suspected infidelity on the part of the women. Domestic violence is among the most unreported crimes worldwide for women. Domestic violence against women affects women’s mental health that can include behavioral problems, sleeping and eating disorders, depression, anxiety, Post-traumatic stress disorder (PTSD), suicide attempts, and many more.


LAWS MADE AGAINST DOMESTIC VIOLENCE:

PROTECTING WOMEN FROM DOMESTIC VIOLENCE ACT, 2005.

· This act may be called the protection of women from domestic violence act, 2005.

· It extends to the whole of India except the state of Jammu and Kashmir.

· It shall come into force on such date as the central government may, by notification in the Official Gazette, appoint.

(1) This Act conduct of the respondent shall constitute Domestic violence in case it,

Harm or injures caused or endangering health, safety, life, limb, or well-being, whether mental or physical, of the aggrieved person or tends to do so and includes causing physical abuse, sexual abuse, verbal and emotional abuse.

(2) Information to protection officer and exclusion of liability of informant:

(a) Any person who has reason to believe that an act of domestic violence has been, or is being, or is likely to be committed, may give information about it to the concerned protection officer.

(3) Jurisdiction:

(a) The court of Judicial Magistrate of the first class or the Metropolitan Magistrate, as the case may be, within the local limits of which,

· The cause of action that has arisen, shall be the competent court to grant a protection order and order under this act and to try offenses under this act.

(b) Any order made in this Act shall be enforceable throughout India.

(4) Appeal:

There shall lie an appeal to the court of the session within thirty days from the date on which the order made by the magistrate is served on the aggrieved person or the respondent, as the case may be, whichever is later.


RESEARCH DONE BY NATIONAL FAMILY HEALTH SURVEY (NHFS):

According to domestic abuse statistics from the National Family Health Survey (NHFS) released by the Union Health Ministry, EVERY THIRD WOMAN, SINCE THE AGE OF 15 HAS FACED VARIOUS FORMS OF DOMESTIC VIOLENCE IN INDIA. The survey also found that 31% of married women have experienced physical, sexual, or emotional violence by their Husbands.


CONCLUSION:

Ways to empower yourself against domestic violence:

The biggest life lessons have come from the realization that people treat you the way you allow yourself to be treated.

1. Don't live in the false hope that things will get better someday.

2. Don't look to other people to save you from your abuser.

3. No one can help you if you're not willing to help yourself.

4. Only you can take action on your behalf- legally and emotionally.

These points can help women legally. Women should always take action against domestic violence so that this violence cannot happen with other girls.
